CASE: Brussels Labour Court judgment (22 May 2020)


​‘A fired employee gets her overtime pay even if she cannot prove it.’

A European Court of Justice ruling on 14 May 2019 stated that member states must ensure that minimum rest periods and maximum working hours are respected. A Brussels Labour Court ruling followed on 22 May 2020: a dismissed worker will be paid her overtime even if she cannot prove it. The employer must have an objective and reliable time-recording system, it said.

In Belgium, time registration is only mandatory in two cases: for sliding hourly schedules and for part-time workers who deviate from their normal work schedule. The Labour Court ruling shows that European rules must be applied even without Belgian legislation, i.e. this ruling could set a precedent. Importantly, this ruling puts the burden of proof on the employer. If you do not have an objective and reliable system to track your employees' working hours, you put yourself in a weaker position if a dispute arises. In this particular case, the employer was unable to present an objective tracking of working hours. Therefore, the court put the ball in his court to prove that the alleged overtime had not been worked.

Does this mean the time clock will be mandatory from now on?

That is still unclear, and needs to be considered on a case-by-case basis. But you would certainly do well to vet your work organisation on that front and map out how your employees feel about it.
